Topic: Legal and Practical Background Check Considerations

Because placing the wrong person in the wrong position can lead to loss, litigation, and liability, employers use a variety of application and interview techniques. But they also realize the importance of verifying the information provided by their employment candidates.

At the same time, dozens of federal class action lawsuits have been filed against employers claiming violations of the Fair Credit Reporting Act (FCRA). This continues a several-year trend of class action lawsuits that have resulted in payouts to applicants and employees, including those who suffered no harm from the defendant-employers’ actions.

In this presentation, we will discuss the ways employers can verify their applicants claims while avoiding the most common causes of background check litigation.

Problem Addressed: Employer’s uncertainty about the contents of background checks and how to legally use them.

Speaker Bio:

Mike Coffey is an entrepreneur, human resources professional, licensed private investigator, and HR consultant.

In 1999, he created Imperative to bring high quality, high tech, and high touch to the employment background screening market.

Today, Imperative serves hundreds of businesses across the US and, through its PFC Caregiver Screening brand, many more private estates, family offices, and personal service agencies.

Mike has been recognized as an Entrepreneur of Excellence and has twice been named HR Professional of the Year. Additionally, Imperative is included in the prestigious Best Places to Work lists for both Fort Worth and Texas and was named the Texas state chamber of commerce’s small business of the year.

Mike maintains his certification as a Senior Professional in Human Resources (SPHR) through the HR Certification Institute. He is also a SHRM Senior Certified Professional (SHRM-SCP).

Mike lives in Fort Worth with his very patient wife and they are one high-school graduation or juvenile court sentencing away from being empty nesters. He practices yoga and maintains a keto diet, about both of which he will gladly tell you way more than you want to know.

What are the typical offsite and off-the-clock behaviors that often land employees and their employers in the courtroom or the newsroom? What behaviors can also compromise physical and/or data security protocols at work? How can proactive HR translate to positive PR for employers as well? These are a few of the issues addressed in this presentation.

  • the connection between employees' on and off-the-clock actions and behaviors on the company.
  • what behaviors can actually compromise other employees' safety and/or sensitive company data.
  • the role that proactive HR has on positive PR for the company.

Speaker Bio: 

Jeff McKissack is a national speaker and trainer in the arena of safety and security issues. He began his career working with an investigative reporter for 20/20, Sixty Minutes, and NBC News -- always related to stories involving violence, exploitation, and prevention. Over 30 years later, he still remains a sought-after speaker on these topics, though now for business related concerns.

Nationally, Jeff speaks at conferences and conventions, conducts employee and various continuing education training, and offers numerous value-add events for companies seeking to better engage their clients. Whether the topics are related to physical concerns, data security concerns, or (today) reputational concerns, Jeff's mantra of teaching you "how to spot trouble 'before' trouble spots you" has never been more relevant to business.

For those of us in the HR profession, Jeff understands the value of both training and documentation, whether related to the need for compliance and/or the need to mitigate potential claims of negligence. He also understands the dynamic of both on-the-clock and off-the-clock behaviors that can negatively impact productivity, profit, and PR. He has been a speaker in the past at Ft. Worth HR, North Texas HR, Mid-Cities HR, Dallas HR, San Antonio HR, and HR Southwest. It is safe to say he is a friend to our profession.
